These Terms of Service ("Terms") govern your use of NANOBANANA's AI image generation service ("Service") operated by NANOBANANA ("us," "we," or "our") at www.nanobanana.global.

Service Description

NANOBANANA provides an AI-powered image generation service that allows users to:

  • Upload images for AI processing and transformation
  • Generate AI-created images in various artistic styles
  • Download and use generated images for personal or commercial purposes
  • Access multiple AI art styles including Barbie, Anime, Realistic, and more

User Accounts

Account Creation

  • You must create an account using Google authentication to use our Service
  • You are responsible for maintaining the confidentiality of your account
  • You must provide accurate and complete information
  • You must be at least 13 years old to create an account

Account Responsibilities

  • You are responsible for all activities under your account
  • You must notify us immediately of any unauthorized use
  • We reserve the right to suspend or terminate accounts for violations

Acceptable Use Policy

Permitted Uses

  • Personal creative projects and artwork
  • Commercial use for business purposes
  • Educational and research purposes
  • Social media and marketing content

Prohibited Uses

  • Generate illegal, harmful, or offensive content
  • Create deepfakes or misleading content
  • Violate intellectual property rights
  • Generate content that promotes violence, hate, or discrimination
  • Create adult or inappropriate content
  • Attempt to reverse engineer or exploit our AI models

Payment Terms

Pricing and Payment

  • Pay-per-generation model: $2.99 per AI image generation
  • Payments processed securely through PayPal
  • All prices are in USD and include applicable taxes
  • No refunds for completed generations

Billing

  • Payment required before each generation
  • Failed payments will prevent service access
  • We reserve the right to change pricing with 30 days notice

Intellectual Property

Your Content

  • You retain ownership of images you upload
  • You grant us license to process your images for service provision
  • You are responsible for ensuring you have rights to uploaded content

Generated Content

  • You own the rights to images generated from your uploads
  • Generated images may be used for personal or commercial purposes
  • We do not claim ownership of your generated content

Our Service

  • NANOBANANA owns all rights to our Service and technology
  • Our AI models and algorithms are proprietary
  • You may not copy, modify, or distribute our Service

Privacy and Data

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

  • We process your images only for service provision
  • Uploaded images are automatically deleted after 30 days
  • Generated images are stored for 90 days
  • We do not use your content to train our AI models

Service Availability

  • We strive for 99% uptime but cannot guarantee uninterrupted service
  • We may perform maintenance that temporarily affects availability
  • We reserve the right to modify or discontinue the Service
  • Generation times may vary based on server load and image complexity

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NANOBANANA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

Our total liability to you for any damages shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

Termination

Termination by You

You may stop using our Service at any time. You can request account deletion by contacting us at support@nanobanana.global.

Termination by Us

  • We may terminate your access for violations of these Terms
  • We may discontinue the Service with 30 days notice
  • We may suspend accounts pending investigation of violations

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the new Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of the United States.
